The Honorable Arnold Schwarzenegger State Capitol Building Sacramento, CA 95814 SUBJECT: Support a Flexible Workweek and Meal Period Reform Dear Governor Schwarzenegger, I am writing to urge you to support legislation to help individual employees achieve greater flexibility in work schedules and greater clarity and flexibility with the meal period statute. Flexible Workweek The Labor code should allow employees to work four 10-hour days a week if the employee desires the schedule and the employer agrees to the compressed schedule. If the employer agrees to the proposed alternative workweek schedule, the alternative workweek will be paid at straight time rates. Any work performed beyond the compressed work schedule would remain subject to current California overtime requirements. Working a compressed workweek provides for up to 50 extra days off each year for the average full-time employee. This compressed workweek will be time for the employee to spend with family, attend children's school activities, take care of dependent elders, go to medical appointments, go back to school or attend to other private matters that usually cannot be accomplished on weekends. Other benefits are reduced traffic and greenhouse gases. Meal Period Reform We also call on you to take action that will provide both employers and employees with the clarity and flexibility needed to comply with the meal period statute, Labor Code section 512. Current law is confusing and has led to costly litigation against California businesses. Historically, state enforcement officials have interpreted the statute and related regulations narrowly and unreasonably, wrongly increasing employer liability. To avoid liability under these interpretations, employers have had to discipline or discharge employees for not taking meal periods as directed. Our troubled economy is too fragile to continue to subject California businesses to an environment that promotes unjustified and unreasonable class action litigation. We urge you to continue to push towards enacting comprehensive solution to this current meal period litigation crisis that would provide a remedy across all industries, all job classifications and all employers – both union and nonunion.
