The Honorable Arnold Schwarzenegger Governor, State of California State Capitol Sacramento, CA 95814 Dear Governor Schwarzenegger: I request your VETO of SB 549 (Corbett), which would unreasonably expand employer’s liability for a new protected bereavement leave for employees. Under current law, employees are provided protected leave for in a variety of instances. This new leave requirement applies regardless of business necessity of the employer – if the employee qualifies for the leave, it must be granted. Increasing the number of circumstances under which an employee is entitled to leave would cause undue hardships for employers. Employee absences are disruptive and interfere with production, necessitating reassignment of work and causing increased costs. This bill proposes to establish new sanctions and rights of action against employers related to this new protected leave. Under this bill, employers would be subjected to civil action in court or enforcement action through the Department of Labor Standards Enforcement. California employers already operate under complex and punitive labor laws. We oppose expansion of leave opportunities for employees that create new liabilities for employers. Creating more complex leave laws and liabilities for California employers sends the wrong message to new or growing businesses that could create jobs for California citizens. For these and other reasons, I request your VETO of SB 549 (Corbett) when it comes before you for consideration.
