Labor Contractors

Existing Law:
Existing law requires an employer to furnish each employee with
an accurate itemized statement showing the name and address of
the employer in order to prove the legal status. It is
considered a misdemeanor if this is intentionally violated.
Proposed Legislation:
This bill would require an employer who is a farm labor
contractor to disclose in the itemized statement the name and
address of the legal entity that secured the employer's
services. Because a willful violation of the bill's provisions
would be a crime, this bill would impose a state-mandated local
program. The California Constitution requires the state to
reimburse local agencies and school districts for certain costs
mandated by the state. Statutory provisions establish procedures
for making that reimbursement. This bill would provide that no
reimbursement is required by this act for a specified reason.
Argument:
This bill would create unnecessary paperwork and bookkeeping
burdens on farm labor contractors.
